Living Wills and Last Wills

A Last Will is a document by which a person (the testator) controls the rights of others over his or her property or family after death. Many times this document needs to be updated or redrafted throughout one’s life as circumstances change.

Your Last Will is a legally binding document that states who will receive your property at your death. It also allows you to appoint a legal representative (personal representative or executor) to carry out your wishes and gives them the power to carry out those wishes.

It is important to have your Last Will drafted by an experienced elder law attorney in conjunction with your individualized estate plan as people’s circumstances are rarely the same. An experienced estate planning attorney can help you draft a complete estate plan to make sure that when you pass away, your wishes will be carried out.
